1.3. The Purpose of the Terms and Conditions
1.3.1. The purpose of these terms and conditions is to set forth the regulation of the legal relationship between WAcademy, its students, and Participants to ensure the professional provision of the services.
1.4. Terms and Conditions as a Legal Agreement
1.4.1. Terms and conditions apply to each visitor or user of WAcademy website, mobile application and/or any other services, applications and features offered by WAcademy.
1.4.2. Terms and conditions constitute a binding and enforceable legal agreement between WAcademy and you in relation to the use of any WAcademy services.
1.4.3. You may visit and/or use WAcademy services only if you fully agree to these Terms and conditions. By using and/or registering to any of the WAcademy services, you affirm your informed consent to these Terms and conditions.
1.4.4. If you do not read, fully understand, and agree to the Terms and conditions, you must immediately leave WAcademy website and avoid or discontinue all use of the WAcademy services.
1.4.5. By using WAcademy services, you acknowledge that you have read our Privacy Policy available at https://academy-w.com/privacy-policy/.
2. Our Services
2.1. Free Web Design and Development Service
2.1.1. WAcademy teaches Web design fundamentals: theory, practice, and real-world experience courses for students all around the world. The last stage of the course is a real-world experience for the students.
2.1.2. With a Free Website design and development service, WAcademy undertakes to create a website for free for any natural or legal person (Participant) by assigning this task to a student.
2.1.3. WAcademy guarantees the quality of the student’s work and undertakes all legal obligations under this agreement.
2.1.4. Free Website development service includes these services:
2.1.4.1. Install and configure WordPress content management system;
2.1.4.2. Install the Elementor Pro page editing tool;
2.1.4.3. Create up to 12 pages specified by the Participant:
2.1.4.3.1. Create a unique design homepage;
2.1.4.3.2.Create up to 11 internal pages.
2.1.4.4. Place the information provided by the Participant on the pages:
2.1.4.4.1. Texts (up to 12 pages (A4) of text written in 12 font size);
2.1.4.4.2. Media (up to 12 photos or videos).
2.1.4.5. Make the design of the website responsive;
2.1.4.6. Place the logo provided by the Participant and the browser window icon (favicon);
2.1.4.7. Integrate a Google map with the address provided by the Participant if the Participant requests the integration;
2.1.4.8. Integrate a contact form that website visitors can fill (up to 10 fields of text) if the Participant requests the integration;
2.1.4.9. Place up to 5 links to social networks specified by the Participant;
2.1.4.10. Host an approved website on the Participant’s domain.
2.1.5. Free Website development service does not include the programming of additional functionality or the installation of additional plugins. The website development service also does not include writing/editing texts and editing photos or other media files.
2.1.6. If the Participant wishes to expand the scope of website development, purchase additional services or extend the functionality of the website, the conditions and procedure for such works may be agreed upon by signing a separate contract or by e-mail determining the exact scope, terms and price.
2.1.7. The Participant undertakes to collaborate with WAcademy during the whole process and to cover the running costs of the website.
2.1.8. The running costs include a domain name, web hosting, and other necessary tools to develop the website.
2.1.9. The Participant is entitled to the Free Website design and development agreement only after she/he covers the running costs on WAcademy’s website.
2.1.10. After the payment for the running costs, WAcademy shall send an email to the Participant with a link to the interactive questionnaire within 3 working days.
2.1.11.The Participant fills in an interactive questionnaire within 15 working days and provides all the necessary information. If the Participant does not provide all the needed information, WAcademy may return the questionnaire for completion. The website is based on the information provided in the questionnaire only. Subsequent additions to the information under this agreement are not possible. Additional information or additional wishes may be added or implemented for an additional fee agreed upon with WAcademy in writing or by email.
2.1.12. The Participant must provide the required information in up to 30 days in order to get the website by the agreed deadline. In case the Participant does not provide the required information within 30 days, the project delivery might delay up to 6 months, depending on the availability of students and/or other resources.
2.1.13. Upon receipt of the duly completed questionnaire, WAcademy assigns the website development task to a student of WAcademy’s choice. The student creates the first version of the website within 15 working days. The student creates the website according to the style preferences indicated in the questionnaire, but the Participant clearly confirms that she/he understands that website development is a creative task that maximally conveys and reflects his vision, but does not guarantee full stylistic compliance or subjective credibility.
2.1.14. After creating the first version of the website, it is delivered to the Participant by sending a link by email. The Participant has the right to submit the amendments she/he wants to make to the first version within 5 working days. Amendments shall be presented in a single document that sets out precisely and specifically what should be changed and how. Additional information or additional requests not specified in the questionnaire or exceeding the provisions of this agreement are not considered changes. In the event that the changes are presented in an unclear or otherwise incorrect manner, WAcademy may return the changes for clarification. In this way, the Participant must adjust the changes within 5 working days. The Participant has a right to submit the amendments once. Additional rounds of changes can be agreed upon by parties in the agreement or via e-mail as well as the fee for the implementation of these changes.
2.1.15. WAcademy shall implement the duly submitted changes within 10 working days of their submission.
2.1.16. Upon implementation of the changes specified by the Participant, the website is considered complete. The website is considered complete also in the event that the Participant does not have any observations or does not submit them within the specified deadline, or does not specify the incorrectly submitted changes.
2.1.17. Upon completion of the website, it is transferred to the Participant’s domain within 5 working days. If because of technical and other objective reasons, as well as in order to ensure uninterrupted operation of the Participant’s communication channels, the transfer of the website may be performed in other terms, ensuring clear mutual communication of the parties by email.
2.2. Free Eshop Development Service
2.2.1. WAcademy teaches Web design fundamentals: theory, practice, and real-world experience courses for students all around the world. The last stage of the course is a real-world experience for the students.
2.2.2. With a Free Eshop design and development service, WAcademy undertakes to create an eshop for free for any natural or legal person (Participant) by assigning this task to a student.
2.2.3. WAcademy guarantees the quality of the student’s work and undertakes all legal obligations under this agreement.
2.2.4. Free Eshop development service includes these services:
2.2.4.1. Install and configure WordPress content management system;
2.2.4.2. Install the Elementor Pro page editing tool;
2.2.4.3. Install and configure the WooCommerce plugin;
2.2.4.4. Create up to 5 product categories;
2.2.4.5. Add up to 16 products with up to 5 photos per product as well as product descriptions;
2.2.4.6. Install the WordPress plugin of the chosen payment gateway. The Participant has to provide all the login details and other information necessary for payment gateway (Paypal, Stripe, other) integration. If the Participant does not provide this information together with an interactive questionnaire, WAcademy has the right to complete the shop development without payment gateway integration;
2.2.4.7. Create up to 12 pages specified by the Participant:
2.2.4.7.1. Create a unique design homepage;
2.2.4.7.2.Create up to 11 internal pages.
2.2.4.8. Place the information provided by the Participant on pages:
2.2.4.8.1. Texts (up to 12 pages (A4) of text written in 12 font size);
2.2.4.8.2.Media (up to 12 photos or videos).
2.2.4.9.Make the design of the eshop responsive;
2.2.4.10. Place the logo provided by the Participant and the browser window icon (favicon);
2.2.4.11. Integrate a Google map with the address provided by the Participant if the Participant requests the integration;
2.2.4.12. Integrate a contact form that eshop visitors can fill (up to 10 fields of text) if the Participant requests the integration;
2.2.4.13. Place up to 5 links to social networks specified by the Participant;
2.2.4.14. Host an approved eshop on the Participant’s domain.
2.2.5. Free Eshop design and development service does not include the programming of additional functionality or the installation of additional plugins. The eshop design and development service also does not include writing/editing texts and editing photos or other media files.

3. Billing and Refund
3.1. The Billing and Refund Policy
3.1.1. It is your responsibility to ensure that your payment information is up to date and that all invoices are paid on time. You agree to pay for the Services in advance of the time period during which such Services are provided. Subject to applicable laws, rules, and regulations, payments received will be first applied to the oldest outstanding invoice in your billing account.
3.1.2. Unless otherwise provided, you agree that until and unless you notify WAcademy of your desire to cancel the services, you will be billed on an automatically recurring basis to prevent any disruption to your services, using your credit card or other billing information on file with us.
3.1.3. Listed fees for the services do not include any applicable sales, use, revenue, excise or other taxes imposed by any taxing authority. Any applicable taxes will be added to WAcademy’s invoice as a separate charge to be paid by you. All fees are non-refundable when paid unless otherwise stated.
3.1.4. If the Participant purchases WordPress hosting services for 1 month, 1, 2 or 3 years, the Participant is covered by a 14-days unconditional money-back guarantee. The amounts paid by the Participant are refunded upon receipt of a written request from the Participant sent by email. WAcademy shall refund the money within 10 working days from the moment of receipt of the request.
3.1.5. If the Participant subscribes to the WordPress hosting services for 1 month, the Participant is subject to the “cancel at any time” rule – the Participant may cancel the subscription at any time. Upon expiration of the subscription term, the WordPress hosting service ceases to operate and payment requests are no longer sent to the Participant. The subscription can be terminated by the Participant logging into his/her account on the WAcademy’s eshop or by submitting a written request by email. Previous subscriptions are non-refundable.
3.1.6. Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled and signed up again, or if you have opened a second account with us, you will not be eligible for a refund.
4. Changes and Updates of the Terms and Conditions
4.1. WAcademy reserves the right to change any of the WAcademy Terms and Conditions with or without prior notice – at any time and in any manner.
